This page defines the terms, user responsibilities, and acceptable use of Nex CRM’s platform and services.

These Terms of Service (“Terms”) govern your use of the Psychoscore website and any services offered by Psychoscore (“Psychoscore,” “we,” “us,” or “our”).

By accessing our website, submitting a form, completing an assessment, scheduling a consultation, purchasing services, or otherwise engaging with Psychoscore, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. Our Services

Psychoscore provides website design, website development, marketing strategy, lead-generation systems, automation, analytics, search engine optimization, advertising support, consulting, and related services.

The exact scope, pricing, timeline, responsibilities, and deliverables for paid services will be described in a proposal, invoice, order form, statement of work, or other written agreement.

If a separate written agreement conflicts with these Terms, the separate written agreement will control for that specific service.

2. Eligibility

You must be at least 18 years old and legally able to enter into an agreement to use our paid services.

If you use our website or services on behalf of a business or organization, you represent that you have the authority to accept these Terms on its behalf.

3. Information and Assessments

Our website may include quizzes, assessments, reports, scores, recommendations, calculators, or other educational tools.

These tools are intended to provide general business and marketing information. They do not constitute legal, financial, accounting, or other professional advice.

Assessment results are based on the information provided and may not reflect every factor affecting your business.

4. Client Responsibilities

When receiving services from Psychoscore, you agree to:

  • Provide accurate and complete information

  • Provide requested content, images, credentials, approvals, and feedback

  • Respond within a reasonable period of time

  • Review deliverables before approving or publishing them

  • Ensure that your products, services, claims, content, and business practices comply with applicable laws

  • Obtain any permissions, licenses, or releases required for materials you provide

  • Maintain appropriate access to your domains, websites, advertising accounts, and third-party platforms

Project timelines may be delayed when requested information, access, content, feedback, or approval is not provided on time.

You are responsible for the accuracy and legality of the final content published for your business.

5. Proposals and Project Changes

Services are limited to the work described in the applicable proposal or written agreement.

Requests that fall outside the agreed scope may require:

  • An additional fee

  • A revised timeline

  • A separate proposal

  • Written approval before work begins

Changes to an approved design, strategy, website, automation, or deliverable may also be considered additional work.

6. Fees and Payments

You agree to pay all fees described in your proposal, invoice, checkout page, or other written agreement.

Unless otherwise stated:

  • Payments are due according to the schedule shown on the invoice or proposal

  • Setup fees become nonrefundable once work has begun

  • Fees for completed work are nonrefundable

  • Monthly fees are nonrefundable for a billing period that has already started

  • You are responsible for applicable taxes

  • We may pause work or access to services when payments are overdue

You authorize us and our payment providers to charge the payment method you provide for amounts you have approved.

Any refund, credit, or exception must be confirmed by Psychoscore in writing.

7. Monthly and Recurring Services

Some services may be provided on a monthly or recurring basis.

The amount, billing frequency, included services, and cancellation terms will be disclosed before you purchase or authorize recurring services.

Unless otherwise stated in writing, recurring services continue until canceled.

To avoid the next recurring charge, cancellation must be submitted before the next scheduled billing date. Cancellation applies to future billing periods and does not automatically provide a refund for a period that has already been billed.

You remain responsible for outstanding balances and fees for work completed before cancellation.

8. No Guarantee of Results

Psychoscore will perform its services in a professional and commercially reasonable manner. However, marketing and business results depend on many factors outside our control.

We do not guarantee:

  • A particular number of leads, customers, calls, appointments, or sales

  • A specific increase in revenue or profit

  • A specific search-engine ranking

  • Approval by Google, Meta, payment processors, advertising platforms, or other third parties

  • That advertising accounts will remain active

  • That every visitor will take a desired action

  • That a website or marketing campaign will operate without interruption

  • That strategies that worked for another business will produce identical results for you

Testimonials, case studies, examples, projections, and previous results are not guarantees of future performance.

Nothing in this section permits either party to make false or misleading claims. The FTC states that advertising claims must be truthful, not deceptive or unfair, and supported by appropriate evidence.

9. Third-Party Platforms

Our services may involve third-party products or platforms such as:

  • Website hosting platforms

  • Domain registrars

  • Google products

  • Social media platforms

  • Advertising platforms

  • Customer relationship management systems

  • Scheduling software

  • Analytics providers

  • Email and text-message providers

  • Payment processors

  • Automation tools

  • Stock image, font, plugin, or software providers

Your use of those products may be governed by the third party’s own terms, policies, pricing, and licensing requirements.

Psychoscore does not control third-party platforms and is not responsible for:

  • Platform outages

  • Policy changes

  • Algorithm changes

  • Account suspensions

  • Changes in pricing

  • Lost access

  • Deleted content

  • Rejected advertisements

  • Reduced reach or performance

  • Security incidents caused by the third-party provider

Fees charged directly by third-party providers are your responsibility unless otherwise stated in writing.

10. Intellectual Property

Psychoscore materials

The Psychoscore name, branding, website content, assessments, frameworks, strategies, designs, text, graphics, software, templates, methods, and other materials are owned by Psychoscore or its licensors.

You may not copy, reproduce, distribute, resell, reverse engineer, or commercially exploit these materials without written permission.

Client materials

You retain ownership of logos, images, text, trademarks, data, and other materials you provide to us.

You grant Psychoscore permission to use those materials as reasonably necessary to perform the requested services.

You represent that you have the necessary rights and permissions to provide those materials to us.

Final deliverables

Ownership and licensing of final paid deliverables will be described in the applicable proposal or written agreement.

Unless otherwise stated, after full payment you may use the approved final deliverables created specifically for your business.

Psychoscore retains ownership of:

  • Pre-existing materials

  • Internal tools and processes

  • Reusable templates

  • Frameworks and methodologies

  • General knowledge and experience

  • Unused concepts and drafts

  • Components licensed from third parties

Third-party fonts, photographs, software, plugins, templates, and other assets remain subject to their original licenses.

11. Client Accounts and Credentials

You are responsible for protecting passwords, login credentials, verification codes, and account access.

You agree to notify us promptly if you believe an account connected to our services has been accessed without authorization.

Psychoscore is not responsible for losses caused by:

  • Credentials shared by you

  • Weak or reused passwords

  • Unauthorized access outside our control

  • A failure to maintain account security

  • Actions taken by your employees, contractors, or other authorized users

12. Confidential Information

Each party may receive confidential or nonpublic information from the other party.

Both parties agree to use reasonable care to protect confidential information and to use it only for the purposes of providing or receiving the services.

Confidential information does not include information that:

  • Is publicly available through no breach of these Terms

  • Was already lawfully known by the receiving party

  • Is independently developed without using confidential information

  • Is lawfully received from another source

  • Must be disclosed by law or court order

13. Communications

When you provide your contact information, we may communicate with you regarding:

  • Your inquiry

  • Assessment results

  • Scheduled appointments

  • Proposals and services

  • Account or billing matters

  • Project updates

  • Products or services that may interest you

Marketing emails may be stopped using the unsubscribe option contained in the message.

Where text-message consent has been provided, you may reply STOP to opt out of marketing text messages. Message and data rates may apply.

Consent to receive marketing communications is not a condition of purchasing services.

14. Acceptable Use

You may not use our website or services to:

  • Violate any law or regulation

  • Infringe another person’s intellectual-property or privacy rights

  • Distribute malware or harmful software

  • Attempt to gain unauthorized access to a website, account, system, or network

  • Send spam or unlawful communications

  • Scrape, copy, or extract our website content without permission

  • Impersonate another person or business

  • Submit false or misleading information

  • Interfere with the operation or security of our website

  • Promote illegal, fraudulent, deceptive, abusive, or harmful activity

We may restrict or terminate access when we reasonably believe these Terms have been violated.

15. Suspension and Termination

You may stop using our public website at any time.

Paid services may be canceled or terminated according to the applicable proposal or written agreement.

Psychoscore may suspend or terminate services when:

  • Payments are overdue

  • Required access or cooperation is not provided

  • A client violates these Terms

  • A client requests unlawful or deceptive work

  • Continuing the relationship could create legal, security, reputational, or operational risk

  • A third-party provider prevents us from continuing the service

Termination does not eliminate amounts already owed for completed work, committed expenses, or services already provided.

When services end, you are responsible for securing access to your accounts, assets, domains, files, and third-party subscriptions.

16. Website Availability

We may change, update, suspend, or discontinue any part of our public website at any time.

We do not guarantee that the website will always be available, error-free, secure, or compatible with every browser or device.

Scheduled maintenance, provider outages, security incidents, or circumstances outside our control may temporarily interrupt access.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website, assessments, content, and services are provided on an “as available” and “as is” basis.

Except for promises expressly stated in a written proposal or agreement, Psychoscore disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted availability.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Psychoscore will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost revenue, lost profits, lost data, lost opportunities, or business interruption.

Psychoscore’s total liability arising from a particular service will not exceed the amount you paid to Psychoscore for that specific service during the six months immediately preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

19. Indemnification

You agree to defend, indemnify, and hold harmless Psychoscore and its owners, employees, contractors, and representatives from claims, losses, damages, liabilities, and reasonable expenses arising from:

  • Materials or instructions you provide

  • Your products, services, advertising claims, or business practices

  • Your violation of applicable law

  • Your violation of these Terms

  • Your infringement of another party’s rights

  • Your misuse of the website or services

Psychoscore will notify you of a covered claim and reasonably cooperate in its defense.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles.

Before beginning a formal legal action, each party agrees to make a reasonable good-faith effort to resolve the dispute informally.

Any legal proceeding must be brought in the state or federal courts located in [COUNTY AND STATE], unless applicable law requires otherwise.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

23. Entire Agreement

These Terms, together with our Privacy Policy and any applicable proposal, invoice, order form, or written service agreement, form the entire agreement concerning the website and services.
